Drain -- ditch repairs -- levy and rate of assessment -- validity. 1. An assessment for ditch repairs by a county board under Minn. St. 1941, Â§ 106.48 (Mason St. 1927, Â§ 6840-53), authorizing
a county board to levy an annual assessment for ditch repairs at a rate not exceeding 30 mills of the assessed benefits as
confirmed in the original proceedings for the establishment and construction of the ditch, is void where the county board
fails to determine a definite rate of assessment. Hence an order of the county board purporting to levy an assessment for
ditch repairs at a rate not exceeding 30 mills on each dollar of the assessed benefits as confirmed in the original proceedings
is void for failure to fix a definite rate.
